NOTICE: It is your responsibility to carefully read these Terms of Use (“Terms”) prior to using our Site or purchasing or accessing any of our products or services, including free or paid offerings, online content, webinars, courses, challenges, digital products, downloadable resources, trainings, email-based programs, or other resources (collectively, “Services”). These Terms govern and define your use of the Site and Services and are legally binding on you.

USE OF OUR SITE AND SERVICES
By accessing or continuing to use our Site, purchasing or accessing any of our Services, or clicking to accept or agree to these Terms when the option is made available to you, you agree to be legally bound by and abide by these Terms and our Privacy Policy.
If you do not agree with these Terms or our Privacy Policy, you must not use or access our Site or Services.
By purchasing or accessing any of our Services, you further warrant that you are at least 18 years old or the applicable age of majority in your jurisdiction and legally able to enter into a contract with us.
If you are using this Site on behalf of your employer, you warrant that you have the authority to bind your employer to these Terms.
If you do not meet these requirements, you must stop using our Site.
COURSE & DIGITAL PRODUCT USE AND CONSENT
By purchasing or accessing any Services, including any online course, challenge, digital product, downloadable resource, training, or email-based program offered through our Site, you agree to abide by these Terms, acknowledge any applicable disclaimers, and agree to our Privacy Policy.
Failure to comply with these Terms may result in termination of your access to our Services.
By purchasing or accessing any Services, you further warrant that you are at least 18 years old or the applicable age of majority in your jurisdiction. Purchasing or accessing our Services if you are a minor is a violation of these Terms, and we reserve the right to terminate your access if we discover that you are a minor.
Some Services and Digital Products may be made available to you immediately following purchase. This may include downloadable materials, workbooks, guides, checklists, video trainings, course portals, and other digital resources.
While we aim to keep our Site and Services as up-to-date as possible, we cannot guarantee that all content will always be entirely accurate, complete, or up to date. Subject to applicable law and any specific commitments made to you at the time of purchase, we reserve the right to modify, update, replace, reorganize, migrate, suspend, or discontinue any Services or Products, in whole or in part.
We are not liable to you or any third party for modifications, price changes, suspension, migration, or discontinuation of Services except where liability cannot lawfully be excluded.
Access to Courses and Digital Products
Where a Service is described as including ongoing access, your access does not expire solely because the stated challenge, course, or program period has ended.
“Ongoing access” does not mean lifetime access and does not guarantee that any particular platform, technology, Service, training, or resource will remain available indefinitely.
We may update, modify, reorganize, migrate, replace, or discontinue portions of our Services or the platforms through which they are delivered. Where reasonably practicable, we will make reasonable efforts to provide notice of a material discontinuation affecting paid digital content, subject to applicable law and any specific written commitments made at the time of purchase.
Where downloadable written resources are provided, you may download and save those materials for your own personal use in accordance with the limited license granted under these Terms.
Video trainings, streaming content, course portal content, and other materials may not be downloadable unless we expressly provide a download option.
Email-Based Program Delivery
Certain Services, including challenges and other programs, may include emails delivered over a specified program period.
You are responsible for providing a valid and accurate email address, maintaining access to that email account, and checking your inbox and applicable spam, junk, or promotions folders for program communications.
You may unsubscribe from marketing communications in accordance with applicable law. However, if you unsubscribe from the email list or communications system used to deliver a purchased email-based program, technical limitations may prevent us from continuing to send the remaining program emails to you.
If you voluntarily unsubscribe from communications necessary for delivery of an email-based program, this does not automatically entitle you to a refund, replacement delivery period, or extension of the program, except where otherwise required by applicable law.
If you believe you are not receiving emails that form part of a purchased Service, please contact us at hello@tara-mckenna.com.

If you wish to request the removal of personal information or access associated with our Site, you may email us at hello@tara-mckenna.com and we will respond in accordance with applicable privacy laws and our legal or business recordkeeping obligations.

You are responsible for your own physical, mental, emotional, personal, professional, and financial well-being and for all decisions, choices, actions, and results arising out of or resulting from your use of our Site or Services.
Tara McKenna is not liable or responsible for your actions or inaction or for any direct or indirect result arising from your use of coaching, consulting, courses, challenges, digital products, educational materials, or other Services.

All intellectual property rights in the Services we provide, derivative works, documents, work product, materials, and other content delivered to you under these Terms shall remain owned exclusively by us unless expressly stated otherwise.
LIMITED LIABILITY
To the fullest extent permitted by applicable law, in no event shall we be liable to you or any third party for any loss of use, revenue, profit, data, diminution in value, or any consequential, incidental, indirect, exemplary, special, or punitive damages arising out of breach of contract, tort, negligence, or otherwise.
You agree, to the fullest extent permitted by applicable law, to defend, indemnify, and hold harmless us and our successors and permitted assigns from and against losses, damages, liabilities, deficiencies, actions, judgments, interest, awards, penalties, fines, costs, or expenses arising from your breach of these Terms or misuse of the Site or Services.
GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, subject to any mandatory consumer protections or other laws that cannot legally be excluded or waived.
FORCE MAJEURE
We shall not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in fulfilling an obligation when and to the extent that the failure or delay is caused by circumstances beyond our reasonable control.
FEES AND REFUNDS
Fees
Fees are as listed on our Site and at checkout and may be stated in Canadian or U.S. dollars. The applicable currency will be clearly displayed at or before checkout.
If you have questions regarding the currency of any Service, please contact hello@tara-mckenna.com before completing your purchase.
Applicable sales taxes may be calculated and added to your purchase where required by law.
If your payment method or financial institution converts your purchase into another currency, the exchange rate and any conversion or international transaction fees are determined by your financial institution, card issuer, payment processor, or other third party and are outside our control.
We reserve the right to change our fees at any time without notice. Any price change will not alter the price of a purchase you have already completed unless otherwise permitted or required by law.
Coaching, Consulting, Courses, Challenges, and Digital Product Refunds
Except where otherwise required by applicable consumer law, purchases of coaching, consulting, courses, challenges, digital products, downloadable resources, trainings, and other digital Services are final and non-refundable.
Many of our digital Services provide immediate access to materials upon purchase. By completing your purchase, you acknowledge that you may receive immediate access to digital content including, but not limited to, workbooks, downloadable resources, guides, checklists, course materials, and video trainings.
Certain Services may also include content or communications delivered over a period of time following your purchase.
Nothing in these Terms limits or excludes any refund, cancellation, withdrawal, warranty, or other consumer right that cannot legally be limited or waived under the laws applicable to you.
European Union Consumers and Right of Withdrawal
If you are a consumer located in the European Union and purchase a Service online, you may have a statutory right to withdraw from an eligible distance contract within fourteen (14) days without providing a reason, subject to applicable law and any exceptions that apply to the particular Service or digital content purchased.
Certain Services include digital content that is supplied or made accessible immediately following purchase.
Where required by applicable law, before receiving immediate access to paid digital content you may be asked to expressly consent to the supply of that digital content beginning during the withdrawal period and to acknowledge that beginning the supply of the digital content may result in the loss of your statutory right of withdrawal in relation to that digital content.
Where a Service begins during an applicable withdrawal period, you may also be asked to expressly request that performance begin during that period. If you subsequently exercise a valid right of withdrawal before the Service has been fully performed, your rights and any amount payable for Services already supplied will be determined in accordance with applicable law.
Where a statutory right of withdrawal applies to an online purchase, an electronic withdrawal function will be made available where required by applicable law. You may also contact us at hello@tara-mckenna.com to communicate a request to exercise a legally available withdrawal right.
Any statutory consumer rights available to you remain unaffected by these Terms.

Injunctive Relief
You acknowledge that certain breaches of these Terms, including infringement or misuse of our Intellectual Property, may cause harm for which monetary damages alone may not be an adequate remedy.
